Cultivation/Production

It is a serious criminal offence if you are accused of the cultivation of cannabis, or producing other drugs. If you are accused of this offence the police and Prosecution must show that:

  • You have been cultivating (growing) any plant of the cannabis family.

Cultivation of cannabis can range from simple growing of cannabis plants to complicated hydroponic arrangements where the plants are grown on a massive commercial scale and involve complex water, heating and lighting arrangements in order to try and maximise the yield of cannabis plants which can be grown. In the same way, the people accused of cultivation range from habitual cannabis users growing a number of plants that they intend to harvest and smoke for their own personal use; to organised gangs who convert entire buildings to complex cannabis farms.

The offence of cultivating cannabis is an either-way offence, this means it can be heard in either the Magistrates or the Crown Court. The maximum sentencing power in the Magistrates Court is 6 months imprisonment, and if the case is dealt with by the Crown Court the maximum is 14 years imprisonment.

The Courts see the cultivation of cannabis as very serious, due to the scientific evidence that cannabis use can cause mental health problems in later life. Because of this, anybody involved in producing cannabis, particularly if it is to sold or distributed to other people, can expect a long prison sentence. Sometimes it is necessary for evidence to be heard about what grower’s intention was for the cannabis crop once it had been produced. In many cases, people will claim that the drugs they were producing were only for their personal use, but the Police and Prosecution do not believe this.

In cases like this it is important that you are represented by someone who will do everything they can and secure as much evidence as possible to place before a Court to try and convince a Judge or jury that the drugs were solely for personal use.
